OVERVIEW
This website is operated by Woody’s Free Range. Throughout these Terms of Service, “Woody’s”, “we”, “us” and “our” refer to Woody’s Free Range.
We provide this website, including its information, products, services and other features, subject to your acceptance of these Terms of Service and any policies referenced within them.
By visiting our website or purchasing from us, you agree to be bound by these Terms of Service. These terms apply to all users of the website, including customers, browsers and anyone who submits content or communicates with us through the website.
Please read these terms before using the website or placing an order. If you do not agree with them, you should not use the website or purchase products from us.
Nothing in these terms limits any rights or remedies that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986, Privacy Act 2020 or other applicable New Zealand law.
SECTION 1 – ONLINE STORE
You must not use our website, products or services for any unlawful or unauthorised purpose.
You must not introduce viruses, malicious code or other material that could damage, disrupt or interfere with the website or its users.
A breach of these terms may result in the suspension or termination of your access to our website or services.
SECTION 2 – GENERAL CONDITIONS
We may refuse or cancel an order where we have a legitimate reason to do so. This may include suspected fraud, incorrect pricing, product unavailability, delivery restrictions, abusive behaviour or an inability to fulfil the order safely.
We may limit the quantity of products purchased by a person, household, business, account, payment method or delivery address.
You must not reproduce, copy, sell, resell or exploit any part of our website or services without our written permission.
SECTION 3 – WEBSITE INFORMATION
We take reasonable steps to ensure that information on our website is accurate and current. However, occasional errors or omissions may occur.
Information such as availability, pricing, product weights, delivery times and product descriptions may change.
General information, recipes, serving suggestions and blog content are provided for guidance only. You are responsible for considering whether a product, recipe or preparation method is suitable for your circumstances.
Nothing in this section excludes our obligations under New Zealand consumer law.
SECTION 4 – PRICES AND CHANGES TO OUR SERVICES
All prices are shown in New Zealand dollars and include GST unless stated otherwise.
Prices may change without notice. The price charged will normally be the price displayed when your order is placed, except where there has been an obvious error.
Delivery charges and any applicable discounts will be shown at checkout.
We may change, suspend or discontinue a product, promotion, service or feature of the website at any time. This does not affect orders that we have already accepted unless we contact you and offer an appropriate alternative or refund.
SECTION 5 – PRODUCTS AND AVAILABILITY
Our products are made from a limited number of animals and are prepared according to weekly production requirements. Availability can therefore change between the time an order is placed and the time it is packed.
We may limit product quantities or discontinue products at any time.
Products may only be available online, in selected stores, in particular regions or during certain seasons.
Products must be stored, handled and cooked in accordance with the instructions on the packaging and normal food-safety practices.
Once an order has been delivered, you are responsible for promptly opening the parcel and refrigerating or freezing the products as appropriate.
SECTION 6 – PRODUCT SUBSTITUTIONS
If an ordered product is unavailable when we pack your order, we may substitute it with the closest reasonably comparable product of equal or greater value.
You will not be charged more for a substituted product. If the replacement is of lower value, we will refund or credit the difference.
Our chilled orders are packed within a short production and dispatch window before collection by the courier. This means we may not have sufficient time to contact you and receive a response before your order must leave our premises.
Unless you tell us otherwise, you authorise us to make a reasonable substitution instead of omitting and refunding an unavailable product.
If you do not want substitutions, write “No substitutions” in the order-notes section at checkout. If you make this request, unavailable products will be omitted and refunded.
We will not knowingly make a substitution where:
• the substitute contains materially different declared allergens;
• you have advised us of a dietary requirement that makes the substitute unsuitable; or
• the substitute is materially different from the type of product ordered.
You remain responsible for reading the product label, ingredients and allergen information before consuming any substituted product.
If you are not reasonably satisfied with a substituted product, contact us within three days of delivery. We will address the issue in accordance with our satisfaction guarantee and your rights under New Zealand consumer law.
SECTION 7 – PRODUCT IMAGES AND NATURAL VARIATION
Images, photographs and videos displayed on our website, social media, advertising and other marketing materials are provided as a general representation of our products.
Meat is a natural product. Its size, shape, colour, fat content, marbling, texture and overall appearance will vary between animals and individual cuts. Hand-cut and handmade products may also vary in dimensions, weight distribution and appearance.
The product supplied will not necessarily be the exact item shown in a photograph or image. It will, however, be the product type and approximate weight or quantity described at the time of purchase.
Some images may show serving suggestions, garnishes, props, cooking equipment, packaging mock-ups or products arranged for presentation. Unless specifically stated otherwise, these additional items are not included with the product.
Natural variations in a meat product’s appearance do not, by themselves, mean that the product is defective or not of acceptable quality.
We will not rely on this section where a product is materially different from its description, incorrectly supplied, unsafe or otherwise fails to meet a guarantee under the Consumer Guarantees Act 1993.
SECTION 8 – ARTIFICIAL INTELLIGENCE AND MARKETING CONTENT
We may use artificial intelligence and other digital tools to assist with creating, editing or developing marketing materials.
This may include:
• written content and product descriptions;
• marketing concepts and layouts;
• backgrounds and lifestyle scenes;
• product and packaging mock-ups;
• images, video and other promotional content; and
• serving suggestions and meal ideas.
Marketing content created or edited with the assistance of artificial intelligence may contain illustrative, enhanced or simulated elements. It should not be treated as a photograph of the exact product that a customer will receive.
We take reasonable steps to review AI-assisted marketing content for accuracy. Material product information, including product names, ingredients, allergens, weights, quantities, prices and preparation instructions, will be based on the applicable product information and not solely on an AI-generated depiction.
Our use of artificial intelligence does not change our obligations under the Fair Trading Act 1986, Consumer Guarantees Act 1993 or Privacy Act 2020.
We will not knowingly submit identifiable customer personal information, private communications, customer photographs or other customer-provided material to a public artificial-intelligence service for marketing purposes without an appropriate lawful basis or the customer’s permission.
Where a third-party technology provider processes personal information on our behalf, that information will be managed in accordance with our Privacy Policy and applicable New Zealand privacy law.
SECTION 9 – PRODUCT WEIGHTS
Many of our products are cut, portioned and packed by hand. Product weights may therefore vary slightly from the stated or target weight.
Where a product is sold at a fixed price, the displayed weight may be an approximate or average pack weight.
Where a product is sold by weight, the final price or quantity will be determined in accordance with the information displayed when the order is placed.
If the supplied weight is materially below the advertised or purchased weight, contact us and we will provide an appropriate partial refund, credit, replacement or other remedy.
SECTION 10 – BILLING AND ACCOUNT INFORMATION
You must provide current, complete and accurate account, contact, billing and delivery information.
You are responsible for checking that your name, email address, telephone number and delivery address are correct before submitting your order.
We are not responsible for delivery failures or additional costs caused by incorrect or incomplete information supplied by you. If an order is returned or redirected because of incorrect information, we may charge any reasonable additional delivery cost.
If we change or cancel an order, we may attempt to contact you using the email address or telephone number provided with the order.
SECTION 11 – ORDER CONFIRMATION AND ACCEPTANCE
After you place an order, we will normally send an email confirming that we have received it.
An order confirmation does not necessarily mean that we have accepted or can fulfil every part of the order.
We may contact you if:
• a product is unavailable;
• there is a pricing or website error;
• we cannot deliver to the supplied address;
• payment has not been authorised; or
• we otherwise cannot safely or reasonably fulfil the order.
If we cannot fulfil an order and cannot provide a reasonable substitute, we will refund the affected amount.
SECTION 12 – ORDER AMENDMENTS AND CANCELLATIONS
Orders may normally be amended or cancelled up to three days before shipment. Our usual weekly order cut-off is Monday at 12 pm.
During the festive dispatch period from 1 December to 31 December, at least seven days’ notice is required for amendments or cancellations.
Christmas hams, roasts, specially prepared products and made-to-order products may not be amended or cancelled once production or preparation has begun.

If a late cancellation relates to products that have already been prepared specifically for your order and cannot reasonably be resold, we may charge a reasonable restocking or cancellation fee of up to 30 per cent.
We will not charge a cancellation fee where doing so would be inconsistent with your rights under New Zealand law.
SECTION 13 – DELIVERY
We normally dispatch orders weekly on Wednesday, subject to production schedules, public holidays and courier availability.
Delivery dates and transit times are estimates unless we expressly agree otherwise.
You are responsible for providing a complete, accurate, safe and accessible delivery location.
If no one is present, the courier may leave the parcel in a place they consider reasonably safe. You authorise the courier to leave the parcel without obtaining a signature unless a different arrangement has been expressly agreed.
You should open the parcel and refrigerate or freeze the products promptly after delivery.
Free-delivery offers do not apply to non-food products unless expressly stated otherwise.
SECTION 14 – RURAL AND OFFSHORE DELIVERIES
We deliver to many rural and offshore addresses. However, overnight delivery is not available or guaranteed for these locations, and delivery may take longer than the period for which our chilled packaging is designed.
All orders delivered to rural or offshore addresses are placed and sent entirely at the customer’s risk.
This includes the risk of:
• courier delays;
• missed delivery targets;
• extended transit times;
• temperature changes;
• deterioration or spoilage; and
• products becoming unsuitable for consumption while in transit.
Our satisfaction guarantee, delivery guarantee, voluntary refund policy and replacement policy do not apply to rural or offshore deliveries where the issue results from courier delay, delivery time, the location of the delivery address or the extended time the products have spent in transit.
We will not provide a refund, credit or replacement for a rural or offshore delivery solely because it:
• arrives later than expected;
• arrives outside the courier’s estimated delivery period;
• experiences a courier delay;
• is affected by extended transit time; or
• deteriorates or becomes unsuitable as a result of that delay or extended transit time.
By placing an order for delivery to a rural or offshore address, you acknowledge and accept these risks.
We strongly recommend that rural and offshore customers provide a non-rural mainland delivery address, such as a workplace, friend’s address or other suitable collection point.
The rural and offshore exclusion does not apply where:
• we sent the wrong product;
• we failed to dispatch the order;
• the product was defective, damaged or unsafe before dispatch;
• the loss was directly caused by something within our reasonable control; or
• a refund, replacement or other remedy is required under New Zealand law.
Nothing in this section excludes or limits any right that cannot lawfully be excluded under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or other applicable New Zealand law.
SECTION 15 – SATISFACTION GUARANTEE
We want you to be satisfied with your purchase.
For eligible non-rural mainland deliveries, if a product is damaged, unsafe, incorrectly supplied or materially different from what you reasonably expected, contact us as soon as possible.
We may ask you to provide:
• your order number;
• a description of the issue;
• photographs of the product, packaging and label; and
• information about the delivery and how the product was stored after it arrived.
Depending on the circumstances, we may provide a replacement, refund, partial refund, store credit or another appropriate remedy.
Our voluntary satisfaction guarantee does not apply to rural or offshore deliveries. These deliveries are made entirely at the customer’s risk, as explained in Section 14.
Our satisfaction guarantee is additional to, and does not replace, any rights that cannot lawfully be excluded under the Consumer Guarantees Act 1993.
SECTION 16 – RETURNS AND REFUNDS
Because meat and other food products are perishable and subject to food-safety requirements, we do not normally require or accept physical returns.
For eligible non-rural mainland deliveries, concerns should be reported within three days of receiving the product where reasonably possible.
Reporting an issue outside that period does not remove any rights that cannot lawfully be excluded under New Zealand consumer law.
Do not discard a product or its packaging until we have had a reasonable opportunity to assess the issue, unless keeping it would create a health or safety risk.
Rural and offshore deliveries are excluded from our voluntary refund, credit and replacement policies where the issue relates to courier delay, extended transit time, temperature changes, deterioration or spoilage during delivery.
If a refund is approved, it will normally be returned to the original payment method. Processing times vary between payment providers and banks.
Contact us if an approved refund has not appeared within seven working days.
Nothing in this section limits any refund, replacement or other remedy that must be provided under New Zealand law.
SECTION 17 – ICE PACK AND WOOL PACK RETURNS
Once you have collected five ice packs, five wool packs or a combination of five packs, you may contact us to arrange their return for cleaning and reuse.
Where this return service is available, we will provide a return label for collection or drop-off with NZ Post.
Contact us with your collection address, name and telephone number to arrange the return.
SECTION 18 – THIRD-PARTY SERVICES AND LINKS
Our website may provide access to third-party tools, payment services, applications or websites.
We do not control third-party websites and are not responsible for their independent content, privacy practices or services.
Your use of a third-party service may be subject to that provider’s own terms and privacy policy.
Nothing in this section excludes responsibility that we cannot lawfully exclude.
SECTION 19 – CUSTOMER CONTENT, REVIEWS AND FEEDBACK
If you submit a review, photograph, comment, recipe, suggestion or other content to us, you confirm that:
• you have the right to provide it;
• it is accurate to the best of your knowledge;
• it does not infringe another person’s rights; and
• it is not unlawful, abusive, defamatory or misleading.
Unless you tell us otherwise, you grant us non-exclusive, royalty-free permission to reproduce, edit and use content that you deliberately submit for publication, review or promotional purposes.
We will not publish private customer communications as marketing content without permission.
We may moderate or remove customer content that is unlawful, misleading, offensive, irrelevant or otherwise inappropriate.
SECTION 20 – PERSONAL INFORMATION
Our collection, use, storage and disclosure of personal information are governed by our Privacy Policy and the Privacy Act 2020.
You are responsible for ensuring that the personal information you provide is accurate and that you have authority to provide information relating to another person.
SECTION 21 – ERRORS AND OMISSIONS
Occasionally, our website or communications may contain an error, inaccuracy or omission relating to a product description, price, promotion, delivery charge, availability or other information.
We may correct errors and update information when they are identified.
If an error materially affects an order you have placed, we will contact you and provide the option of accepting the corrected order or receiving a refund.
We will not rely on this section to avoid responsibility for misleading conduct or a false or misleading representation under the Fair Trading Act 1986.
SECTION 22 – INTELLECTUAL PROPERTY
The website and its content, including our branding, logos, designs, photographs, text, graphics and product information, are owned by or licensed to Woody’s Free Range.
You may use the website for personal and lawful shopping purposes.
You must not reproduce, distribute, modify, sell or commercially exploit our content without written permission.
SECTION 23 – PROHIBITED USES
You must not use the website:
• for an unlawful purpose;
• to infringe our rights or another person’s rights;
• to submit false or misleading information;
• to transmit malicious software or code;
• to collect another person’s personal information without authority;
• to send spam or other unsolicited communications;
• to scrape or automatically extract website content without permission; or
• to interfere with the operation or security of the website.
We may suspend or terminate access where we reasonably believe the website is being misused.
SECTION 24 – LIMITATION OF LIABILITY
To the maximum extent permitted by law, we are not liable for indirect or consequential losses arising from the use of our website or products.
We are not responsible for losses caused by events outside our reasonable control, provided we have taken reasonable steps to avoid or reduce their effects.
Nothing in these terms excludes or limits liability for:
• fraud or wilful misconduct;
• a breach of rights that cannot legally be excluded;
• a failure to comply with the Consumer Guarantees Act 1993 where that Act applies; or
• misleading or deceptive conduct under the Fair Trading Act 1986.
SECTION 25 – BUSINESS PURCHASES
Where products are acquired for business purposes, and it is fair and reasonable for the parties to be bound by this section, the parties agree that the Consumer Guarantees Act 1993 will not apply to the extent permitted by law.
This exclusion does not apply to ordinary purchases made by consumers for personal, domestic or household use.
SECTION 26 – INDEMNITY
To the extent permitted by law, you agree to compensate us for reasonable loss, cost or expense directly caused by your unlawful use of the website, deliberate breach of these terms or infringement of another person’s rights.
This section does not apply to the extent that the loss was caused or contributed to by us.
SECTION 27 – SEVERABILITY
If any provision of these terms is found to be unlawful, invalid or unenforceable, that provision will be modified or removed only to the extent necessary.
The remaining provisions will continue to apply.
SECTION 28 – NO WAIVER
If we do not immediately enforce a provision of these terms, that does not mean we have waived our right to enforce it later.
SECTION 29 – CHANGES TO THESE TERMS
We may update these Terms of Service from time to time by publishing a revised version on our website.
The terms applying to an order will generally be those in effect when the order was placed.
Your continued use of the website after updated terms are published means that the updated terms will apply to your subsequent use of the website and future orders.
SECTION 30 – GOVERNING LAW
These Terms of Service are governed by the laws of New Zealand.
Any dispute will be subject to the jurisdiction of the New Zealand courts, without limiting any right a consumer may have to use the Disputes Tribunal or another applicable dispute-resolution process.
